1. Acceptance of Terms

1.1 These Terms & Conditions ("Terms") apply to all users of the phtaya5 platform, including the website located at phtaya5.org and any associated mobile-optimized interfaces (collectively, "the Platform").

1.2 By accessing or using any part of the phtaya5 Platform, you acknowledge that you have read these Terms, that you understand them, and that you agree to be bound by them. Your continued use of the Platform following any amendment to these Terms constitutes your acceptance of the revised Terms.

1.3 phtaya5 reserves the right to update, modify, or replace any part of these Terms at any time. We will notify registered players of material changes via email or a prominent notice on the Platform. It is your responsibility to review these Terms periodically.

2. Eligibility

2.1 To register and use phtaya5, you must satisfy all of the following eligibility requirements:

• You are at least 21 years of age. This is the minimum legal age for casino-style gambling in the Philippines and is strictly enforced by phtaya5.
• You are a natural person and not a corporation, partnership, or other legal entity.
• You are accessing the Platform from a jurisdiction where online gambling is not prohibited by applicable law.
• You are not a current employee, contractor, or immediate family member of an employee or contractor of phtaya5 or any of its affiliated game providers.
• You have not previously been excluded from phtaya5 or had an account terminated for breach of these Terms.

2.2 phtaya5 reserves the right to request documentary proof of age and identity at any time. Failure to provide satisfactory verification documents within a reasonable timeframe may result in account suspension and withholding of funds pending investigation.

2.3 It is the sole responsibility of the Player to ensure that their use of the phtaya5 Platform complies with all applicable laws in their jurisdiction. phtaya5 makes no representation that the Platform is lawful in all jurisdictions.

3. Account Registration

3.1 To access real-money games on phtaya5, you must create a registered account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate.

3.2 Each individual may hold only one (1) active phtaya5 account. The creation of multiple accounts by the same individual — whether using different email addresses, names, or payment methods — is strictly prohibited. phtaya5 employs technical and manual measures to detect duplicate accounts. Where duplicate accounts are identified, all associated accounts may be suspended and balances forfeited.

3.3 You are solely responsible for maintaining the confidentiality of your phtaya5 account credentials, including your username and password. You must not share your login details with any third party. phtaya5 will not be liable for any loss or damage arising from unauthorized access to your account resulting from your failure to keep your credentials secure.

3.4 You must notify phtaya5 immediately if you suspect unauthorized access to your account. Contact details are provided in Section 15 of these Terms.

3.5 phtaya5 accounts are personal and non-transferable. You may not sell, transfer, or assign your account or any rights associated with it to any other person.

4. Deposits and Withdrawals

4.1 All financial transactions on phtaya5 are denominated in Philippine Peso (PHP / ₱). The minimum deposit amount is ₱100. Minimum and maximum withdrawal amounts are displayed in the Player's account dashboard and may be updated from time to time.

4.2 phtaya5 supports the following payment methods for Filipino players: GCash, PayMaya, BPI, BDO, and Metrobank. Additional payment methods may be added or removed at phtaya5's discretion.

4.3 Deposits are credited to your phtaya5 wallet upon confirmation of receipt. phtaya5 does not charge fees on deposits, though your payment provider may apply their own transaction fees.

4.4 Withdrawal requests are subject to identity verification. phtaya5 reserves the right to request Know Your Customer (KYC) documentation — including a government-issued ID and proof of payment method ownership — before processing any withdrawal. This is a standard anti-money laundering (AML) requirement.

4.5 phtaya5 aims to process withdrawal requests promptly. GCash and PayMaya withdrawals are typically processed within minutes of approval. Bank transfer withdrawals may take one to three business days depending on the receiving institution.

4.6 phtaya5 reserves the right to delay or withhold withdrawals where there is a reasonable suspicion of fraudulent activity, bonus abuse, or breach of these Terms, pending investigation.

5. Bonuses and Promotions

5.1 phtaya5 may offer bonuses, free bets, cashback, and other promotional incentives to registered players from time to time. All promotions are subject to specific terms, including wagering requirements, minimum odds, game restrictions, and validity periods, which will be communicated at the time the promotion is offered.

5.2 Bonus funds are separate from real-money funds in your phtaya5 wallet. Wagering requirements must be met before bonus-derived winnings can be withdrawn. The applicable wagering multiplier for each promotion will be stated in the promotion's specific terms.

5.3 phtaya5 reserves the right to withdraw, modify, or cancel any promotion at any time without prior notice. Where a promotion is cancelled after a Player has already opted in, phtaya5 will honour any wagering already completed under the original terms.

5.4 Bonus abuse — including but not limited to the use of multiple accounts to claim the same promotion, collusion between players to meet wagering requirements, or the use of automated software to exploit promotional offers — is strictly prohibited and will result in account suspension and forfeiture of all associated balances.

6. Game Rules and Betting

6.1 All games available on phtaya5 are governed by the rules of the respective game provider. By participating in any game, you agree to be bound by those rules in addition to these Terms.

6.2 All bets placed on phtaya5 are final once confirmed. phtaya5 does not accept requests to cancel or amend confirmed bets except where a technical error has demonstrably affected the outcome of a game.

6.3 In the event of a technical malfunction, disconnection, or system error during a game session, phtaya5 will endeavour to resolve the issue fairly. Where a game round cannot be completed due to a technical fault, the wager for that round will be refunded to the Player's phtaya5 wallet.

6.4 phtaya5 reserves the right to void any bet or game result where there is evidence of manipulation, exploitation of a software error, or any other form of unfair play.

7. Prohibited Conduct

7.1 The following conduct is strictly prohibited on the phtaya5 Platform:

• Using automated software, bots, scripts, or any other artificial means to place bets or interact with the Platform
• Colluding with other players to gain an unfair advantage in any game
• Exploiting software bugs, glitches, or errors for financial gain
• Using the Platform for any money laundering, fraud, or other illegal financial activity
• Providing false or misleading information during registration or verification
• Accessing the Platform using a VPN or proxy service to circumvent geographic restrictions
• Engaging in any conduct that disrupts the experience of other players or the operation of the Platform

7.2 phtaya5 employs fraud detection systems and cooperates with relevant authorities to investigate and report suspected illegal activity. Players found to have engaged in prohibited conduct will have their accounts immediately suspended and may be reported to the appropriate regulatory or law enforcement bodies.

8. Intellectual Property

8.1 All content on the phtaya5 Platform — including but not limited to the phtaya5 brand name, logo, website design, game interfaces, text, graphics, and software — is the intellectual property of phtaya5 or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.

8.2 You are granted a limited, non-exclusive, non-transferable licence to access and use the phtaya5 Platform for personal, non-commercial gaming purposes only. You may not reproduce, distribute, modify, or create derivative works from any phtaya5 content without prior written consent.

9. Limitation of Liability

9.1 To the maximum extent permitted by applicable law, phtaya5 shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of winnings, loss of data, or loss of profits.

9.2 phtaya5's total aggregate liability to any Player in connection with these Terms shall not exceed the total amount deposited by that Player in the twelve (12) months preceding the event giving rise to the claim.

9.3 phtaya5 does not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components. The Platform is provided on an "as is" and "as available" basis.

9.4 Nothing in these Terms shall limit or exclude phtaya5's liability for fraud, gross negligence, or any other liability that cannot be excluded by law.

10. Privacy and Data

10.1 phtaya5 collects, processes, and stores personal data in accordance with its Privacy Policy, which is incorporated into these Terms by reference. By using phtaya5, you consent to the collection and processing of your personal data as described in the Privacy Policy.

10.2 phtaya5 will not sell your personal data to third parties. Data may be shared with payment processors, game providers, and regulatory authorities where required for the operation of the Platform or compliance with applicable law.

11. Responsible Gaming

11.1 phtaya5 is committed to promoting responsible gaming. We provide the following tools to help players manage their gaming activity:

• Deposit Limits: Set daily, weekly, or monthly caps on deposits to your phtaya5 wallet
• Session Timers: Receive automatic reminders of how long you have been playing

12. Account Suspension and Termination

12.1 phtaya5 reserves the right to suspend, restrict, or terminate any Player account at its sole discretion, with or without prior notice, where:

• The Player has breached any provision of these Terms
• phtaya5 has reasonable grounds to suspect fraudulent, illegal, or abusive activity
• The Player has failed to complete identity verification within a reasonable timeframe
• Regulatory or legal obligations require phtaya5 to do so

12.2 Upon termination of an account for breach of these Terms, phtaya5 reserves the right to forfeit any remaining balance in the account, including both real-money and bonus funds, where such forfeiture is warranted by the nature of the breach.

12.3 Players who wish to voluntarily close their phtaya5 account may do so by contacting our support team. Any remaining real-money balance (excluding bonus funds subject to incomplete wagering requirements) will be returned to the Player's verified payment method.

13. Amendments to These Terms

13.1 phtaya5 reserves the right to amend these Terms at any time. Where amendments are material, phtaya5 will provide reasonable notice to registered Players via email or a prominent notice on the Platform prior to the changes taking effect.

13.2 Your continued use of the phtaya5 Platform after the effective date of any amendment constitutes your acceptance of the revised Terms. If you do not agree to the amended Terms, you must cease using the Platform and may request account closure in accordance with Section 12.3.

14. Governing Law and Dispute Resolution

14.1 These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

14.2 Any dispute arising out of or in connection with these Terms or your use of the phtaya5 Platform shall first be submitted to phtaya5's customer support team for informal resolution. phtaya5 will endeavour to resolve all disputes within fourteen (14) business days of receipt.

14.3 Where a dispute cannot be resolved informally, both parties agree to submit to the exclusive jurisdiction of the competent courts of the Philippines.

14.4 Nothing in this section shall prevent phtaya5 from seeking injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or to prevent irreparable harm.
